1. Introduction
Welcome to ThistleWoodPark ("we," "us," or "our"). These Terms & Conditions ("Terms") control your use of our yacht charter facilities and the website at thistlewoodpark.xyz (the "Service") provided by ThistleWoodPark.
By reserving a charter or by using our Service, you are agreeing to these Terms. If you do not agree with any aspect of these Terms, you are prohibited from using the Service.
2. Overview of Services
ThistleWoodPark offers exclusive yacht charter services, which include, but are not limited to:
- Renting a yacht for the day
- Evening boat tours
- Business getaways
- Exclusive celebrations
- Long-term yacht hires
Offered services depend on both availability and weather conditions. We have the right to change or discontinue services without prior notice.
3. Charter Booking and Reservations
3.1 Reservation Procedure
To secure a charter, you need to:
- Reach at least the age of 18 years
- Provide valid and full information
- Make the necessary down payment as detailed in the booking confirmation
- Accept these Terms & Conditions
3.2 Booking Confirmation
A confirmed booking is only guaranteed once payment has been made and you have received a formal acknowledgment from us. We reserve the authority to decline to provide the service to anyone at our own discretion.
3.3 Charter Availability
The ability to book charters is contingent on yacht availability and appropriate weather conditions. We will strive to meet your preferred dates and times for charters to the best of our ability.
4. Terms of Payment
4.1 Fee Structure
All fees are given in € and include all applicable taxes, unless stated otherwise. Pricing is subject to change with no prior notification.
4.2 Payment Installments
- Deposit: 50% of the overall cost of the charter is due at the time of booking
- Remaining Balance: Must be paid 48 hours prior to the departure of the charter
- Supplementary expenditures (if any): Due upon the charter's completion
4.3 Payment Options
We accept major credit cards, electronic bank transfers, and bank-certified cheques. All payment processing is conducted through secure, encrypted channels.
5. Policy on Cancellations and Refunds
5.1 Cancellations by Clients
- With more than 72 hours notice before departure: Complete refund minus transaction fees
- Between 24 to 72 hours before departure: 50% refund
- Fewer than 24 hours before departure: No refund given
5.2 Cancellations Due to Weather
If our captain deems the weather conditions unsafe, we will suggest:
- Rescheduling your charter to an alternate available date without any additional cost
- Issuing a full refund if a reschedule is not feasible
5.3 Mechanical Failures
If a mechanical failure occurs with the vessel designated for your charter, we will make efforts to arrange a suitable replacement. Should a replacement not be available, we will issue a complete refund.
6. Conduct and Safety
6.1 Safety Obligations
It is mandatory for all passengers to:
- Comply with the instructions provided by the crew
- Use the safety equipment as instructed when required
- Disclose any health conditions that may impact their safety
- Stay within the areas of the vessel that are designated
6.2 Banned Items
The items listed below are strictly prohibited aboard:
- Containers made of glass
- Illegal drugs
- Guns or other types of weapons
- Excessive amounts of non-alcoholic drinks beyond reasonable consumption
- Animals (unless preauthorized)
6.3 Behavior
Passengers are expected to behave respectfully at all times. We hold the right to terminate a charter with immediacy and without issuing a refund if a passenger's conduct is hazardous or disrupts others' experiences.
7. Insurance and Liability
7.1 Our Responsibility
Our liability is limited solely to the cost paid for your charter. We bear no responsibility for:
- Bodily harm due to passenger's own actions
- The theft or destruction of personal belongings
- Secondary, accidental, or punitive damages
- Delays that arise from weather or other factors beyond our influence
7.2 Insurance Protection
We carry comprehensive marine insurance that covers our fleet and business activities. It is the responsibility of the passengers to secure their individual travel and personal insurance coverage.
7.3 Acceptance of Risk
Your participation in our charters suggests you fully understand the natural risks involved in marine activities and you take personal responsibility for your safety and welfare.
8. Itinerary and Schedule Modifications
We retain the right to make changes to itineraries, pathways, or schedules due to weather influences, safety concerns, or operational demands. We will exert every effort to ensure comparable experiences are provided.
9. Force Majeure
We are not responsible for delays, cancellations, or changes caused by factors outside of our control, which can include, but are not limited to:
- Severe weather events
- Natural catastrophes
- Regulatory impositions
- Port shutdowns
- Vessel malfunctions
10. Data Protection and Privacy
Your personal data is managed in accordance with our Privacy Policy. Utilizing our services indicates your agreement to the gathering and application of your data as outlined in our Privacy Policy.
11. Intellectual Property Rights
The content on our website, such as texts, illustrations, trademarks, and images, is secured by copyright and trademark statutes. You are prohibited from copying, sharing, or making adaptations of the content without our express written permission.
12. Law of Governance
These Terms are upheld by the laws in place in Greece. Any disputes will be settled in the courts located in Athens, Greece.
13. Terms Adjustments
We reserve the right to alter these Terms at any given time. Amendments will be shown on our website along with an updated revision date. Continuing to use our services signifies your acceptance of the new terms.
